Abstract

The development of technology and the internet has facilitated transactions through marketplaces, but it also increases the risk of counterfeiting famous marks. This research aims to identify the forms of famous mark counterfeiting in the marketplace, as well as evaluate the effectiveness of existing legal protection and law enforcement. Using a qualitative approach through a literature study, this research finds that counterfeiting of famous marks occurs in various forms and is often difficult to detect. Existing legal protections, such as the Trademark and Trade Law in Indonesia, still face various challenges in its implementation. Comprehensive measures involving the active role of brand rights holders, the government, and marketplace platforms are needed to improve the effectiveness of protection and enforcement against counterfeiting of famous marks. Strong implementation and synergy between relevant parties are expected to minimize the practice of counterfeiting famous marks and create a healthy trade climate.
